Premises
These General Conditions of Sale apply, exclusively, to all future sales contracts concluded between the "Seller" (the details of which are specified in the previous point) and the Buyer (subsequently, when referred to jointly, even only the “Parties”), through the website www.mynatoo.com (hereinafter for brevity also just the “Site”), unless they are modified by express agreement accepted in writing by both Parties.
These General Conditions of Sale also govern any conditions published on the Site, further rules and/or instructions on the Site, as well as any registration form or Purchase Order issued for the conclusion of sales contracts.
It is therefore necessary to read the contents of these General Conditions of Sale carefully and in full, to understand all the conditions and terms of purchasing the Products .
The Products that can be purchased are all the items sold by the Seller on the Site, such as, by way of example but not limited to, clothing products, food products and sports accessories, all present in the electronic catalog published on the Site at the time of the purchase. Purchase Order by the Buyer.
Any typographical errors or omissions, clerical or other errors present in any sales document, price lists, offers, invoices, catalogues, manuals or other information documents issued by the Seller will be corrected without this giving rise to any liability on the part of the Seller.
Purchase Order and conclusion of the sales contract
The presentation of the Products on the Site is not binding for the Seller and constitutes a simple invitation to offer.
To place a Purchase Order on the Site you must be at least 18 years old and have an e-mail address; it is also necessary to set your browser so that pop-ups and cookies are accepted in order to use all the features of the Site.
To place a Purchase Order, the Buyer must find the Product they wish to purchase, add it to the cart and select the delivery, payment and invoicing options. After checking the correctness of the data in the Purchase Order, the Buyer must send it online following the instructions on the Site.
The Buyer is bound to the Purchase Order when he clicks on the "send order" button. Any modifications and/or cancellations of orders already submitted by the Buyer are therefore ineffective, unless they are expressly authorized in writing by the Seller. The Buyer is also responsible towards the Seller for the accuracy of the data contained in the Purchase Order.
Once the Purchase Order has been received, the Site will display an automatic confirmation receipt - printable - containing the order number and purchase details.
If the entire purchase procedure has been completed regularly and correctly, without any error messages being highlighted by the Site, and if the verification of the regularity of payment of the purchase price by the Buyer has been successful , the sales contract with the Seller is considered concluded.
The Seller reserves the right not to accept the Order for any reason, as well as to cancel the purchase even after sending the confirmation receipt.
The Seller has the right not to accept the Order and/or cancel the purchase, without being held responsible for any damages and/or costs suffered by the Buyer, in the following cases:
- The product is not available (in this case the purchase price will be refunded);
- There was an error in the indication of the purchase price;
- The billing data is neither correct nor verifiable;
- The payment was not made within the agreed payment terms;
- The Seller's security system marks the Purchase Order as “risky”.
Technical information and product images
The technical information included in the Site is obtained from the information published by the manufacturer of the Products included in the catalogue. The Seller, therefore, declines all responsibility for any errors in the technical data sheets. The images and photos used to accompany each Product description sheet, drawn up by the manufacturer, are merely indicative and may not be perfectly representative of the characteristics of the Products.
The Seller reserves the right to modify and/or adapt the technical and dimensional information of the products in the catalog based on what will be communicated by the producers, even without any prior notice.
Product Prices
The prices of the Products published on the Site include VAT applicable by law; they do not include shipping costs, any insurance and any other additional sum that the Buyer may be required to pay to the Seller.
The automatic confirmation receipt indicates the total price including taxes and shipping costs.
The prices of the Products displayed on the Site may be subject to change. The Seller reserves the right to change prices even without notice. It is also possible that the price information contained on the Site contains errors: in this case, the Seller is not bound by what is indicated on the Site and reserves the right to cancel the purchase in the event of errors of this type.
Terms of payment
The Buyer will be able to pay the purchase price of the Products only if the verification of the payment information has been successful.
Payments in execution of the purchase contract can be made, alternatively, by credit card or PayPal if delivery takes place in Italy. The Buyer is required to choose the chosen payment method at the time of completing the Purchase Order.
Payment by card
The Buyer who chooses "Credit Card" as a payment method will be able to pay with all cards that have the Visa, MasterCard and Maestro logo.
In order to protect the Buyer's security to the maximum degree, the Seller will never become aware of the credit card number, which is only received by the banking institutions that must provide the authorization. The Seller will only be notified of the outcome of the transaction.
The Seller is not responsible for any fraudulent or illicit use of credit cards that may be made by third parties during the payment procedure for the Products.
Payment information is encrypted from the time it is entered into the system until the transaction is processed, and is not stored on a public server. Even if you use secure software, the protection of information and payments made online cannot be guaranteed.
Payment with Paypal
The buyer who chooses "PayPal" as the payment type must follow the following procedure: by clicking on "SEND YOUR ORDER", after confirming the Purchase Order data, the PayPal login page will open to access the account and complete the payment. If the Buyer does not yet have a PayPal account, he or she can create one from the PayPal login page before completing the purchase order.
Shipping and Delivery
Shipments to Italy
Shipments are made throughout Italy within 24/48 hours of receiving the Purchase Order, via express courier. Orders received are generally shipped by the next business day. Deliveries take place every day, excluding weekends and holidays, via land transport within the purely indicative terms contained in the order confirmation receipt, within 24/48 hours following the shipping date. However, delivery terms are not binding and any delay does not entitle the Buyer to request any compensation for damages. The Buyer is required to promptly notify the Seller of any delays in the delivery of the Products.
The Products will be delivered to the address indicated by the Buyer when placing the Purchase Order.
Upon delivery of the Products, the courier will require the presence of a person to receive the package and a signature for the delivery also by a third party other than the Buyer who will be custodian and responsible for the package and all any costs that are associated.
The courier's delivery times are approximately from 8.30 to 18.00; It is usually not possible to choose a fixed delivery time. The Seller assumes no responsibility for delays in scheduled delivery, particularly if due to problems attributable to the Courier.
The Buyer undertakes to carry out any other activity to guarantee the possibility of exercising all possible actions against the transport company or third parties, with particular reference to damage to the products, loss of the same, etc.
The Buyer undertakes to inspect the packaging and the Products upon receipt. If the package containing the Products appears damaged, it is necessary to acknowledge this by writing "damaged" or "subject to inspection" on the delivery document. If the goods have also suffered damage, the Buyer is required to inform the Seller, in writing, within 24 hours of receiving the Products. The Seller will then, at its own expense, have the damaged items collected and replaced. The Seller does not accept complaints if only the signature appears on the delivery note without any other indications.
If the courier does not find anyone at the delivery address indicated by the Buyer, he will leave a message with instructions to collect the package. If the package is returned to the Seller due to non-response from the Buyer, the Seller reserves the right to charge the Buyer for transport costs.
Shipping costs are free for orders over €35; for orders under €35 the shipping costs will be €5.90 and will be charged to the Buyer on the invoice.
Shipments abroad
Shipments are made within 24/48 hours of receiving the Order, using an express courier. Shipping is free for orders over €39.90 and for a package weighing less than 20 kg; for orders under €39.90 the shipping costs will be €15.00 and will be charged to the Buyer on the invoice.
For orders involving multiple packages and weighing more than 20 kg, the Buyer is required to contact Customer Service to find out the shipping methods and costs. Shipments to non-EEC countries are subject to additional costs such as customs duties which are entirely borne by the Buyer.
Passing of risks
The risks of damage or loss of the Products pass to the Buyer when the Seller delivers the goods to the carrier from its warehouses.
Retention of title
Regardless of delivery and passing of risks relating to the Products, or any other provision of these General Conditions of Sale, the Seller reserves ownership of the Products until full receipt of the purchase price.
Right of withdrawal
Except as otherwise established in these General Conditions of Sale, the Buyer has the right to withdraw from the Purchase Order, without having to provide reasons, within 14 days of the conclusion of the purchase contract for Products not supplied on a material support (e.g. CD or DVD), or upon receipt of the ordered Product.
The notice of withdrawal must be sent, no later than the aforementioned deadline, to the Seller via email to the address: info@mynatoo.com . The e-mail must specify the items you intend to return and the type of compensation desired: size change, credit to your account or refund. Once the return request has been received, the Seller will send the Buyer a written confirmation via email, containing the return number. The Buyer can then proceed with sending the returned Product to the following address: Nutrilife srl, via Persicetana Vecchia, 18 40132 Bologna, Italy, no later than 14 days from the day on which the withdrawal was communicated. The cost of returned shipping will be borne by the Buyer. The re-sending of the changed product, as per the Buyer's instructions, will be the responsibility of the Seller.
Effects of the right of withdrawal and refunds
Once the returned Product has been received, the Seller will proceed with the refund to the Buyer within approximately 10 days from the date of receipt. Orders paid with Paypal will be refunded to the original account.
Conditions for exercising the right of return
The Buyer is required to try the Products without removing the tags and seals, as items cannot be returned if they are not in the same condition in which they were sent and inside the original packaging.
The Buyer cannot exercise the right of withdrawal in the following cases:
- if the product has been ordered expressly for the Buyer and/or has been tailor-made and/or personalized;
- if the product is declared open;
- in the case of sealed food products, after their opening;
- if the product has been worn and/or washed;
- if the product is declared unopened in the online form when in reality it is;
- if the product is not complete;
- if the product is likely to deteriorate or expire rapidly;
- if the product, once opened, is by its nature mixed inseparably with other goods;
- in the case of newspapers, periodicals or magazines , audiovisual products or computer software;
- if the Product, sealed, opened after delivery, is not suitable for return for hygienic reasons or reasons related to health protection .
The original box containing accessories, footwear and/or supplements is considered to all intents and purposes an integral part of the Product; therefore, it must not show signs of damage, under penalty of failure to authorize the return. The boxes cannot be used by the Buyer as packaging for return shipping .
Limitations of Liability
The estimated shipping and delivery times of the Products as well as their availability are purely indicative information and therefore it is not possible to rely on them completely. The Seller therefore reserves the right not to accept or cancel confirmed orders for Products that are not available in stock; in this case, any payments made by the Buyer will be refunded.
The Seller assumes no responsibility in the event that, due to misunderstandings or other inconveniences, the price indicated on the Site is different from the actual price.
To the extent permitted by law, the Seller declines all responsibility in the event that the Product does not comply with the legislation of the delivery country other than Italy.
Furthermore, the Seller is not responsible for any inconvenience or damage that may arise from the use of the Site.
Finally, the Seller declines all responsibility for any failure to fulfill its contractual obligations in the event of unforeseeable circumstances or force majeure.
Guarantees
The purchase of the Products entails the full acceptance by the Buyer of the warranty conditions provided by the manufacturer. The Buyer, therefore, is aware of the fact that the Products purchased will be guaranteed by the manufacturer under the conditions established by the same and therefore accepts, with all reservations removed, all the methods of provision of the manufacturer's warranty. To this end, on the Site the Buyer will find an indication of the identity of the producers and the warranty conditions applied by them.
The consumer buyer has the right to the legal guarantee of conformity pursuant to the Consumer Code. In case of application of this guarantee, the Buyer will have the right to restore, without charge, the conformity of the Product with the sales contract, through repair or replacement, or, if this is not possible, to a reduction in the purchase price or upon termination of the contract. Provided that the Buyer has reported the defect within two months of discovery, the Seller is liable for defects of conformity if they appear within two years of delivery of the product.
The Buyer will not be entitled to the guarantee described above if:
- The Products have been repaired or altered by third parties other than the manufacturer or the Seller itself;
- The lack of conformity manifested itself after 2 years from delivery of the Product and/or the related report was sent 2 months after the discovery of the defect;
- The defects are due to misuse or poor maintenance and/or installation.
Without prejudice to the other limitations of liability agreed in these General Conditions of Sale, the Seller is not responsible in the event of non-substantial differences between the Products purchased and their illustrative images and descriptions published on the Site. Any discrepancies cannot be the subject of a guarantee. considered usual in trade and those that cannot be technically avoided, especially those concerning quality, colours, workmanship, designs, and the like.
Furthermore, the Seller is solely responsible for direct and foreseeable damages at the time of conclusion of the contract and the related reimbursement cannot in any case exceed (if applicable) the purchase price of the Products.
Applicable law and competent court
These General Conditions of Sale and future sales contracts for the Products stipulated between the parties are governed by Italian law.
For any dispute that may arise in relation to these General Conditions of Sale and/or in relation to future sales contracts, including their validity, as well as in relation to any purchase made online on the Site, the Court of Bologna will have exclusive jurisdiction .
Website trademarks and copyrights
All brand and product names used on the Site are trademarks or trade names owned by third parties. No use or reproduction of such trademarks or trade names is permitted.
Information and consent for the processing of personal data
By accepting the General Conditions of Sale, the Buyer expressly authorizes the Seller to process the Personal Data provided. The information prepared pursuant to art. 13 of Legislative Decree 196 of 06.30.2003 (“Code regarding the protection of personal data”), which can be consulted on the Site, is to be considered an integral part of these General Conditions of Sale.
Final provisions
These General Conditions of Sale supersede and cancel any other obligations and guarantees that may have been agreed upon by the parties orally or in writing prior to this date, and which are therefore to be considered null and ineffective.
The sales contracts subject to these General Conditions of Sale cannot be assigned or transferred by the Buyer without the written consent of the Seller.
Each party will bear all legal, accounting and/or other expenses and costs incurred in the performance of its obligations.
Any partial invalidity of a clause contained in these General Conditions of Sale, or any partial invalidity of a clause contained in any other contractual document aimed at regulating the relationship between the Parties, will not lead to the invalidity of the other conditions contemplated herein. .
The Seller reserves the right to modify the Site, the policies and these General Conditions of Sale at any time.
